new Delhi. The Supreme Court will give its verdict today in the matter of scrapping the most important rule under the SC-ST Act. In fact, after the case was registered under the SAC-ST Act, the provision for immediate arrest was scrapped, after which there was a lot of controversy. Due to this, a petition was filed in the Supreme Court and the appeal was to withdraw the order of March 2018, which said that under the SAC-ST Act, he would not be arrested immediately.
The court had given two decisions under this act, in the first order, the court said that there will be a provision for anticipatory bail in the case of Dalit oppression, while the second order said that the case would be investigated before arrest. After this decision of the court, there was a lot of opposition across the country. In view of the heavy opposition and political pressure, the Central Government appealed to the Court to reconsider its decision. After which today the court can give an important decision in this case.
The center protested
The central government had said that this decision scrapped the most important provision of the SAC-ST Act, which has weakened the confidence of the SAC-ST class people that the state can protect them. The court said that this change was necessary to save innocent people. The court had said that misuse of this law has been done on some occasions, government employees have been prevented from doing their work.
Parliament changed the decision
Explain that earlier, the Supreme Court had issued a notice to the Central Government on a petition challenging the amendment made in the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act to restore its earlier status. In August last year, Parliament passed an amendment bill overturning a Supreme Court order on March 20, prohibiting arrests without preliminary investigation to avoid false accusations of innocent people under the Act.
It provides that no preliminary investigation is required to register a criminal case and no prior permission is required for arrest under this law. Let me tell you that after the change in this act, reversing the decision of the Supreme Court, there were also protests in some parts of the country, especially in Rajasthan, Madhya Pradesh, Bihar and Uttar Pradesh.
