Chandigarh: The State Consumer Disputes Redressal Commission has imposed a fine of Rs 5 lakh on the PepsiCo India Company. In fact, the customer found a dead worm in a bottle of Mountain Dew, after which he complained in the Consumer Forum. But the Consumer Forum rejected the complainant's petition. After this, the complainant challenged the order of the forum in the State Consumer Disputes Redressal Commission. Now, while hearing the petition of the complainant, the commission has imposed a fine of five lakh rupees on PepsiCo India Private Limited Company, making Mountain Dew.
The complainant's lawyer Fateh Jeet Singh said that the commission has ordered to deposit Rs 2.5 lakh in the PGI Poor Patient Fund and Rs 2.5 lakh in the Consumer Legal Aid account. Along with this, the company has also asked the complainant to pay Rs 60,000 as compensation amount and Rs 25,000 as case expenses for the problem caused by the complainant. In addition, the shop from which the bottle was purchased ordered him to return Rs 35 of the bottle to the complainant.
Found a dead worm
Naveen Sethi resident of Mohali told in an appeal that on 21 June 2015, he bought a bottle of Mountain Dew for Rs 35 from Munshi Ram Dev Raj Mahajan Kariyana & General Merchant Shop located in Sector-23. A dead worm and other things were present in it. He gave a complaint in the Consumer Forum. But his complaint was rejected by the forum.
Support CAA, then make missed call immediately
The forum said that the bottle was sent for testing after one year from the manufacturing date. The test was sent to the Public Analyst Government Lab, Chandigarh. After investigation, the fluid in the bottle was said to be unsafe. But the forum still rejected the petition. At the same time, the commission said that what can be seen clearly can be ignored.
PepsiCo Company argues
Arguing in their favor, the PepsiCo company said that the case Naveen has made against them is not made. Said that some fake manufacturing companies are selling beverages using their brand name. Against which he has given a complaint to the police.
For this, it was also claimed that the complainant had neither bought the bottle nor found any dead worm in it. Apart from this, the shop from which the bottle was purchased did not appear in the commission, due to which the commission has now declared this decision, declaring it as X party.
